SGP Performance 110 West Helgra Deer Park, Tx.77536 attn. owners: Mark Gust and Kyle Puckett It is with great disappointment that your decision of not responding to my latest phone calls and emails requesting your help in repairing my car as I have paid in full have all gone ignored. My patience with each of you and your lack of customer service and ability to repair my car as I have paid you in full to do is gone. My car was initially dropped off to your company at the end of September 2000. The car was never completed until the middle of May 2001. The reasons for this (seven plus months of waiting for cars return )were do to your companies inability to return my car to me with THE MOTOR AND TURBOS working as I paid to have them rebuilt. This period of time was initially SUPPOSED to be only a COUPLE TO THREE MONTHS. My motor and turbos were pulled out of my car approx. FIVE plus times while I had to wait well over SEVEN MONTHS FOR YOU GUYS TO GET WHAT I PAID IN FULL FOR (PRIOR) TO MY CARS COMPLETION, CORRECT. Key word is correct as ALL PROBLEMS YOUR COMPANY HAD IN DELIVERING MY CAR TO ME AS PAID FOR HAVE BEEN DOCUMENTED THROUGHOUT THIS WHOLE PROCESS. Including my first trip to pick up the car in January, 2001. This disappointment as I drove a quarter mile away from your shop only TO RETURN THE CAR WITH A KNOCKING MOTOR AND OIL SMOKE OUT OF THE BACK. How could your work have been checked prior to my arrival??? THIS WAS ONE OF FOUR TOTAL TRIPS I HAD TO TAKE TO GET MY "COMPLETED CAR". EACH TIME I DROVE OFF THE CAR HAD NOTED PROBLEMS THAT YOU TOLD ME TO DRIVE A FEW DAYS AND SEE IF IT CLEARS UP. EACH TIME INCLUDING MY LAST ATTEMPT TO PICK UP MY COMPLETED CAR HAS BEEN RETURNED TO ME WITH PROBLEMS WITHIN THE WORK I PAID FOR. It is still not right and I have been abandoned and left with THOUSANDS OF DOLLARS IN MORE REPAIRS/DIAGNOSTICS/PARTS to restore my car to the condition I paid your company to do. Your CHOICE TO IGNORE MY REQUEST FOR HELP NOW HAVE FORCED ME TO DISPUTE ALL CHARGES I MADE TO YOUR COMPANY SINCE LEAVING IT WITH SGP AT THE END OF SEPTEMBER 2000. I have advised my credit card of the possibility of this dispute for approx. two months WHEN IT SEEMINGLY APPEARED AS THOUGH SGP WOULD BE UNABLE TO DELIVER WHAT HAD BEEN PAID FOR TO BE COMPLETED ON MY CAR. My research with others have found that I am not alone when it comes to your companies decision to JUST LET A CUSTOMER HANG OUT TO DRY in some similar situations. I.E. WESLEY STRONG. As previously noted in my last two emails to you, I DID NOT WANT TO HEAD DOWN THIS PATH. YOU LEAVE ME NO CHOICE AS I HAVE NO OTHER RECOURSE TO HAVE ALL OF MY CREDIT RETURNED SO THAT I MAY HAVE WHAT I ORIGINALLY PAID SGP TO DO DONE BY A MORE REPUTABLE AND COMPETENT PERFORMANCE SHOP. HAD YOU RESPONDED AND TRIED TO WORK WITH ME IN REPAIRING THE PROBLEMS MY CAR STILL HAS after THE LAST TIME(F-O-U-R-T-H) time to come to Houston to get it, then MY FULL DISPUTE WOULD NOT BE NECESSARY. However, YOUR SILENCE is not what was needed. Therefore, This is my formal request for SGP to ISSUE FULL CREDIT FOR EACH INSTALLMENT/PAYMENT I MADE TO SGP FOR THE CAR I RECENTLY PICKED UP THE MIDDLE OF MAY 2001. Charges were made per your request for the work being done on my car starting OCTOBER 2000. These charges made to your company were made(per your request) and in good faith based upon all parts and labor be done correctly on my 93 Twin turbo 300zx license plate IFLYU1. Unfortunately, the cars last (completion) was the middle of May 2001. The car still has major problems and you will not respond to my request for help. I HAVE A PICTURE TAKEN YESTERDAY OF PLUMES OF WHITE OIL SMOKE BILLOWING OUT THE EXHAUST OF MY CAR. I TOOK THE PICTURE ON A DIGITAL CAMERA WITH A LARGE SIGN BETWEEN THE EXHAUST MARKING THE DATE OF 6-19-01. I HAD ADVISED EACH OF YOU OF THIS CONDITION WITHIN THE FIRST WEE I HAD THE CAR BACK. IT DID NOT SUDDENLY REPAIR ITSELF AND I AM LEFT WITH THE BILL TO REPAIR THIS EXPENSIVE CONDITION WHICH HAS NEVER BEEN FIXED SINCE LEAVING YOUR SHOP. I.E. TURBOS THAT YOU REBUILT FOR THE THIRD TIME WHILE HAVING MY CAR. At this point I will expect that full credit BE ISSUED BACK TO MY DIRECT REWARDS VISA BY FRIDAY AT NOON, JUNE, 22, 2001. If not as I WOULD IMAGINE that your continued decision to ignore me continues, than I will submit my formal dispute to the dispute department of Visa. Again I request one FINAL ATTEMPT FOR EITHER OF YOU TO CALL ME ASAP TO DETERMINE WHAT WOULD BE AN AGREED WAY TO REPAIR MY CAR OR REIMBURSE ME FOR THE FURTHER/CONTINUED EXPENSES I AM HAVING TO ENDURE FOR YOUR COMPANIES INABILITY TO DELIVER MY CAR BACK TO ME WITH ALL I PAID FOR WORKING CORRECT. If I do not hear from you by noon on Friday, June 22,2001 then my dispute will be initiated with CHELE PHELAN of the Visa DIRECT REWARDS DISPUTE DEPARTMENT. 1-800-404-3032 ext 4353. I wish for a more amiable resolution outside of dispute but your decision to ignore my latest request for help with my cars continued problems have left me no choice. I may be reached at work or cell 972-814-3590. I am again sorry that you have allowed this situation to escalate to this level. Please do not leave this as my only option of recourse. Please contact Visa dispute department to verify that NORMAL DISPUTE PERIODS DO NOT ALWAYS APPLY AS IN THIS CASE WHERE WHAT I PAID FOR WAS NOT DELIVERED UNTIL JUST A FEW WEEKS AGO. MARK GUST, I WILL NOW GLADLY ACCEPT YOUR VERBAL OFFER TO GIVE ME ALL OF MY MONEY BACK AS YOU OFFERED AFTER MY EMAIL TO YOU REGARDING MY FIRST DISAPPOINTING ATTEMPT TO GET MY CAR IN JANUARY. I RECALL YOUR OFFER AS IT WERE GIVEN AS A THREAT TO LEAVE ME WITH MY CAR IN A NON WORKING CONDITION AS IT WERE WHEN THE MOTOR KNOCKED AND STILL SMOKED, OR DID I WANT IT FIXED. AS I TOLD YOU THEN, I JUST WANTED WHAT I PAID FOR. WELL I STILL HAVE NOT RECEIVED IT AND YOU GUYS HAVE ME ON IGNORE. ESSENTIALLY THAT IS WHERE I HAVE BEEN LEFT BY YOUR COMPANY. I HAVE MAJOR EXPENSIVE REPAIRS/PARTS/LABOR TO BE MADE ON WORK THAT YOUR COMPANY FAILED TO GET CORRECT. I WILL GLADLY ACCEPT YOUR VERBAL OFFER TO REFUND ALL OF MY MONEY AND I WILL GLADLY RETURN MY SMOKING TURBOS, LEAKING THROTTLE BODIES, AND PAY FOR ALL NEW BEARINGS AND GASKETS THAT WERE INSTALLED IN MY MOTOR AS SOON AS FULL CREDIT IS ISSUED TO MY DIRECT REWARDS VISA.. I have had enough and am ready to go the next step if either of you continue to IGNORE MY REQUEST. I waited and gave you an extra two days to respond to me as I told you in my last email I would start the dispute process at noon Monday June 18,2001. Respond now and resolve this or issue full credit back to my card. Damaged parts will be returned to you or replaced with new ones for those that are not already damaged once credit is issued. Your response must be received by 6-22-01 @ noon or my dispute will be set in to motion. The choice is totally yours. I suggest you call Alamo Autosports and asked them what happened when the same/similar situation occurred three years ago. I will eagerly await your response Mark or Kyle. By the way what happened to your promise of "Bring it back we will fix it if it breaks" Mark??? This hardly fits those comments as my car has never been problem free since it left your company. Sincerely, David Snell Technical Services Manager DataPro Consultants, Inc. (972) 503-5000 ext. 203 (972) 503-2200 fax
